DeltaOne Software does not collect any personal information through the RFID SGTIN app.

HARDWARE SERIAL NUMBERS
The serial number only of your RFID scanning hardware is hashed and collected solely for the purpose of counting distinct devices connected to the app for licensing and subscription purposes. That hash value cannot be reversed by DeltaOne Software or anyone else.

ONLINE CONTACT FORMS
If you choose to contact DeltaOne Software by filling an online contact form through the app, we will use the information you provide to contact you back. Use of a contact form is optional. Any personal information you voluntarily provide through a contact form may be stored in our customer contact database. We will never sell your contact information to anyone.
We may employ third party companies and individuals for contacting customers in our database. When this occurs, limited contact information will be temporarily shared with that third party.

LICENSE
By installing and using the RFID SGTIN application ("Software") on any device, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software. The Software is licensed, not sold, to you by DeltaOne Software ("Licensor") for use strictly in accordance with the terms and conditions of this EULA.

GRANT OF LICENSE
a. The Licensor hereby grants you a personal, non-exclusive, non-transferable, limited license to use the Software on any Android device that you own or control and as permitted by the Google Play Store Terms of Service.
b. This license does not allow you to use the Software on any device that you do not own or control, and you may not distribute or make the Software available over a network where it could be used by multiple devices at the same time.
c. You may not rent, lease, lend, sell, redistribute or sublicense the Software.
d. You may not copy (except as expressly permitted by this license and the Usage Rules), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Software, any updates, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law).

SUBSCRIPTIONS
The basic functionality of the Software is provided free of charge. A subscription, purchasable via the Google Play Store, is required to access all features of the Software. Subscription terms and conditions will be provided and agreed upon within the Google Play Store platform.

REQUIREMENTS
To use all features of the Software, users must have a supported handheld RFID reader. The availability of features may vary depending on the availability and functionality of your device.

PRIVACY
a. The Software may collect information about your device and subscription for the purpose of providing service and support.
b. The Licensor does not share this information with third parties.

NO WARRANTY
You expressly acknowledge and agree that use of the Software is at your sole risk. The Software and any related documentation are provided "AS IS" and without warranty of any kind. LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

LIMITATION OF LIABILITY
To the extent not prohibited by law, in no event shall Licensor be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use the Software, however caused, regardless of the theory of liability (contract, tort or otherwise) and even if Licensor has been advised of the possibility of such damages.

GOVERNING LAW
This EULA is governed by the laws of the State of California, without regard to its conflict of law principles. The exclusive jurisdiction and venue for any disputes arising out of or relating to this EULA will be the state and federal courts located in Orange Count, California.

TERMINATION
The license is effective until terminated by you or Licensor. Your rights under this license will terminate automatically without notice from the Licensor if you fail to comply with any term(s) of this EULA. Upon termination of the license, you shall cease all use of the Software and destroy all copies, full or partial, of the Software.

MISCELLANEOUS
If any term of this EULA is held to be invalid or unenforceable, the remaining provisions will remain in effect. This EULA constitutes the entire agreement between you and Licensor and supersedes all prior or contemporaneous understandings regarding such subject matter.

By continuing to use the Software, you hereby acknowledge that you have read and understood this End User License Agreement and agree to be bound by its terms.
